1. Acceptance of Terms

By creating an account or using SmartScheduleAI, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the service.

2. Description of Service

SmartScheduleAI is a subscription-based AI-powered social media scheduling platform that allows businesses to upload videos, generate AI-written social media posts, and schedule content across multiple platforms including TikTok, Instagram, YouTube, Facebook, X (Twitter), and LinkedIn.

3. Subscription & Payment

SmartScheduleAI is available on monthly, quarterly, and annual subscription plans. All subscriptions are billed in advance. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.

• Monthly subscriptions renew every 30 days
• Quarterly subscriptions renew every 90 days
• Annual subscriptions renew every 365 days
• You may cancel at any time — cancellation takes effect at the end of your current billing period

4. Acceptable Use

You agree not to use SmartScheduleAI to publish content that is illegal, defamatory, harassing, or violates any third-party platform's terms of service. You are solely responsible for all content you publish through our platform.

5. Account Security

You are responsible for maintaining the security of your account credentials. Bagel Barron LLC is not liable for any loss resulting from unauthorized use of your account.

6. Service Availability

We strive to maintain 99.9% uptime. In the event of significant downtime that materially impacts your ability to use the service, we may issue account credits or subscription extensions at our discretion. We are not liable for outages caused by third-party social media platforms.

7. Intellectual Property

The SmartScheduleAI platform, including its software, design, and AI systems, is owned by Bagel Barron LLC. You retain ownership of all content you upload and publish through the platform.

8. Termination

We reserve the right to suspend or terminate accounts that violate these Terms of Service. You may cancel your subscription at any time through your account dashboard.

9. Limitation of Liability

To the maximum extent permitted by law, Bagel Barron LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of SmartScheduleAI.

10. Governing Law

These Terms of Service are governed by the laws of the State of New York. Any disputes shall be resolved in the courts of New York.

Bagel Barron LLC ("we", "us", "our") operates SmartScheduleAI. This Privacy Policy explains how we collect, use, and protect your information.

• Account Information: Name, email address, and billing information when you create an account
• Social Media OAuth Tokens: Access tokens for connected social platforms, encrypted with AES-256
• Content: Videos you upload and AI-generated posts created on your behalf
• Usage Data: Log data, feature usage, and performance metrics to improve the service

2. How We Use Your Information

• To provide and improve the SmartScheduleAI service
• To publish content to social media platforms on your behalf
• To process payments and manage your subscription
• To send service-related communications (no marketing without consent)
• To comply with legal obligations

3. Data Storage & Security

Your data is stored on servers located in the United States. All social media OAuth tokens are encrypted using AES-256 encryption. We do not store your social media passwords. We implement industry-standard security measures to protect your data.

4. Third-Party Services

SmartScheduleAI integrates with the following third-party services to operate:

• Cloudflare (video storage and delivery)
• Google Gemini API (AI content generation)
• Stripe (payment processing)
• TikTok, Meta, Google, LinkedIn, Twitter/X (social media publishing)

5. Data Retention

We retain your account data for as long as your account is active. Upon account cancellation, your data is retained for 30 days before deletion. You may request immediate deletion by contacting support.

6. Your Rights

You have the right to access, correct, or delete your personal data. You may also request a copy of your data at any time by contacting us.

7. Cookies

We use essential cookies for authentication and session management. We do not use advertising or tracking cookies.

Our Commitment to You

While we do not offer refunds, we are fully committed to ensuring your success with our platform. If you experience any technical issues or problems with the service, we will:

• Resolve technical issues promptly with priority support
• Issue subscription extensions for any significant platform downtime that impacts your ability to schedule content
• Provide account credits for documented service disruptions caused by our platform
• Work with you directly to resolve any issues at no additional charge

What This Policy Covers

This no-refund policy applies to:

• Monthly, quarterly, and annual subscription payments
• Partial months of service
• Unused video quota in any billing period
• Downgrades from a higher plan to a lower plan

Service Credits & Extensions

At our sole discretion, Bagel Barron LLC may issue service credits or subscription extensions in the following circumstances:

• Extended platform outages (more than 4 hours of continuous downtime)
• Technical failures on our end that prevent you from scheduling posts
• Other unforeseen circumstances that materially impact service delivery

Credits and extensions are issued at our discretion and do not constitute a right to refund.

Cancellation

You may cancel your subscription at any time through your account dashboard. Cancellation takes effect at the end of your current billing period. You will retain full access to all features until your subscription expires.

Disputes

Before initiating any payment dispute or chargeback, we ask that you contact our support team first. We will make every reasonable effort to resolve your concern. Chargebacks filed without prior contact may result in account suspension.
